Welcome to Textured Memories. These Terms of Service (“Terms”) govern your use of the Textured Memories website, products, customization services, and related services (“Services”). By accessing our website, submitting materials, or placing an order, you agree to these Terms.

1. About Textured Memories

Textured Memories creates custom pet keepsakes, artwork, jewelry, tactile impressions, and related personalized products. Because many of our products are individually created from customer-provided photographs, prints, impressions, scans, or other reference materials, variations are an expected part of the custom creation process.

2. Orders and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Payment is due at the time indicated during checkout or ordering. An order is not considered accepted until payment has been successfully processed and Textured Memories has accepted the order for production.

We reserve the right to refuse, cancel, or refund an order when necessary, including in cases involving pricing errors, suspected fraud, unavailable materials, unsuitable reference materials, or requests we are unable to reasonably produce.

3. Custom and Personalized Products

Many Textured Memories products are made specifically for you and cannot be resold.

You are responsible for reviewing names, dates, wording, photographs, customization selections, shipping information, and other information you provide before submitting your order.

Because our products may involve artistic interpretation, digital processing, image refinement, engraving, printing, sculpting, or other production methods, the finished product may not be an exact reproduction of the source material.

Minor differences in color, texture, placement, dimensions, depth, grain, finish, or other characteristics are normal and are not considered defects.

4. Paw, Nose, Print, and Other Impression Materials

Textured Memories may create products using photographs, ink prints, paw prints, nose prints, physical impressions, scans, or other reference materials.

The quality and accuracy of the finished product depend in part on the quality of the materials provided to us. Textured Memories may digitally clean, isolate, reconstruct, enhance, or otherwise refine submitted materials when necessary to create a suitable finished product.

When portions of an impression or image are unclear, incomplete, obscured, or missing, reasonable artistic reconstruction may be used.

Because each animal and source image is unique, we cannot guarantee that every submitted reference will be suitable for every product or production method.

5. Customer-Provided Photos and Materials

By submitting a photograph, image, artwork, print, impression, scan, or other material to Textured Memories, you represent that you own the material or have permission to use it for the products you are requesting.

You grant Textured Memories permission to reproduce, modify, crop, enhance, process, convert, and otherwise use the submitted material as reasonably necessary to create and fulfill your order.

Ownership of your original submitted content remains with you.

Unless you separately give us permission, customer-provided photographs and personalized designs will not be used for unrelated public advertising or promotional purposes.

6. Proofs and Approvals

Certain products may include a digital proof before production.

When a proof is provided, you are responsible for reviewing it carefully. Once you approve a proof, production may begin and changes may no longer be possible.

Approval confirms acceptance of the design, including layout, spelling, image selection, customization, and other visible elements shown in the proof.

Minor differences between a digital proof and the physical finished product may occur because of differences in materials, displays, printing, engraving, texture, lighting, and manufacturing processes.

7. Production and Turnaround Times

Production and delivery estimates are estimates and are not guaranteed unless expressly stated otherwise in writing.

Custom production may be affected by order volume, material availability, equipment maintenance, shipping carrier delays, holidays, weather, or other circumstances outside our reasonable control.

If an order is time-sensitive, please contact us before ordering so we can determine whether your requested timeline can reasonably be accommodated.

8. Shipping

Customers are responsible for providing a complete and accurate shipping address.

Once an order has been transferred to a shipping carrier, delivery timing is subject to the carrier's operations.

Textured Memories is not responsible for delays caused by shipping carriers, incorrect customer-provided addresses, weather, or circumstances outside our reasonable control.

If your package arrives damaged, please contact us promptly and retain the product and packaging so we can evaluate the issue.

9. Returns, Cancellations, and Refunds

Because personalized and custom-made products are created specifically for each customer, they generally cannot be returned or exchanged because of a change of mind, preference, or customer-provided error.

Cancellation may be possible before customization or production begins. Once design work, customization, or production has started, cancellation or refund options may be limited.

If we make an error or your product arrives damaged or materially defective, please contact us promptly. We will evaluate the issue and, when appropriate, repair, replace, reproduce, or refund the affected product at our discretion.

Nothing in this section limits any rights you may have under applicable law.

10. Memorial and Irreplaceable Materials

We understand that materials associated with a pet may have significant emotional and sentimental value.

Whenever possible, we recommend providing digital copies, photographs, scans, or reproductions rather than mailing irreplaceable originals.

If Textured Memories agrees to receive an original physical item, reasonable care will be taken while it is in our possession. However, customers should not send irreplaceable original materials unless specifically requested or agreed to by Textured Memories.

11. Veterinary, Aftercare, and Other Business Partners

Textured Memories products or information may be offered or provided through veterinary hospitals, pet aftercare providers, cremation providers, shelters, rescues, retailers, or other independent businesses.

Unless expressly stated otherwise, these businesses are independent entities and are not employees, agents, or representatives of Textured Memories.

Availability, pricing, payment arrangements, fulfillment methods, and included services may vary depending on the partner program through which a customer receives access to Textured Memories.

Additional terms may apply to participating business partners under separate agreements.

12. Gift Cards, Promotions, and Discount Codes

Promotional offers, discounts, referral codes, credits, or gift cards may be subject to additional restrictions or expiration terms disclosed with the applicable offer.

Unless otherwise stated, promotions cannot be combined and have no cash value.

We reserve the right to correct or cancel promotions that have been issued or applied in error or used fraudulently.

13. Intellectual Property

The Textured Memories name, logos, branding, website design, product photography, original artwork, product designs, written content, graphics, and other original materials are owned by Textured Memories or used with permission and are protected by applicable intellectual property laws.

You may not reproduce, distribute, sell, copy, modify, or commercially exploit our proprietary content without prior written permission.

Purchasing a physical product does not transfer ownership of Textured Memories' underlying intellectual property, production methods, templates, designs, or other proprietary materials.

14. Website Use

You agree not to misuse our website or Services, interfere with their operation, attempt unauthorized access, submit malicious code, engage in fraudulent activity, or use our Services in violation of applicable law.

We may restrict or terminate access when we reasonably believe our website or Services are being misused.

15. Product Safety and Intended Use

Unless specifically identified otherwise, Textured Memories products are decorative keepsakes and are not toys.

Products may contain small parts and should be kept away from children or pets when they could present a choking, ingestion, entanglement, or other safety hazard.

Customers are responsible for using and displaying products appropriately.

16. Disclaimer of Warranties

To the extent permitted by applicable law, our Services and products are provided without warranties beyond those expressly stated by Textured Memories.

We do not guarantee that our website will always operate uninterrupted or error-free.

Nothing in these Terms excludes warranties or protections that cannot legally be excluded under applicable law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Textured Memories will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, Services, or products.

To the maximum extent permitted by law, our total liability relating to a product or order will not exceed the amount paid to Textured Memories for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law.

18. Privacy

Your use of our website and Services is also subject to our Privacy Policy.

Because customers may provide photographs, contact information, pet information, shipping information, and other materials in connection with an order, we encourage you to review our Privacy Policy to understand how information is collected, used, stored, and shared.

19. Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, or legal requirements.

The current version will be posted on this page with its effective or “Last Updated” date.

Your continued use of our Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

20. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.
